Midjourney Challenges Hollywood Studios to Prove Copyright Compliance Amid Rising Legal Disputes

The copyright dispute between Hollywood studios and generative AI has escalated into a contentious discovery phase. In the lawsuit filed by Disney, Universal Studios, and Warner Bros. against Midjourney, the AI company has launched a counterattack, demanding that the studios reveal specific details regarding their internal use of AI technology.
The crux of this legal battle centers on the scope of discovery. Although a previous court ruling limited the studios' obligation to provide only final "consumer-facing" video and image files, Midjourney has rejected this restriction. The company argues that such a definition is selective and designed to deny it access to crucial defense evidence. Midjourney contends that these withheld documents could reveal whether the studios are engaging in the same activities they accuse Midjourney of—using copyrighted material without authorization to train AI models.
In its latest court filing, Midjourney argued that if the studios are developing image generation models for internal creative purposes, these practices demonstrate that AI has become an "industry norm" in film production. By making this point, Midjourney seeks to show the court that the studios themselves rely on similar technological approaches, thereby undermining the claim of "infringement." Furthermore, Midjourney has requested that the studios fully disclose all prompts and generated results used, aiming to comprehensively assess the current state of AI usage in creative concept development and storyboarding.
In response, David Singer, attorney representing the Hollywood studios, pushed back. He characterized Midjourney's request as an improper "fishing expedition" intended to indiscriminately extract the studios' internal core information. Singer emphasized that the studios are not trying to hinder technological progress but are instead demanding that Midjourney cease using and distributing their classic film content and character copyrights without permission.
As the case progresses, this clash over AI training data and copyright boundaries extends beyond the immediate interests of the parties involved. It has become a pivotal milestone in defining future AI usage standards and liability assignments within the film industry. Currently, the standoff regarding the scope of evidence disclosure remains unresolved.
