The "Opt-Out by Default" Controversy: Private Repositories Lose Their Absolute Privacy
GitHub's updated privacy policy states that users of the free Copilot tier, Copilot Personal (Pro), and Copilot Business (Pro+) are all subject to this data collection. The system will automatically gather detailed information, including code snippets, prompts and outputs, cursor context, and even file names and directory structures. What concerns the community most is that code within "private repositories" could also be sampled for model training if a user edits it with Copilot enabled. GitHub's Chief Product Officer, Mario Rodriguez, explained that internal testing showed real interaction data substantially improves the AI's bug detection accuracy. However, this "opt-out" rather than "opt-in" approach has sparked significant backlash, with dissent rapidly accumulating on the announcement thread.
How to Opt Out: Exemptions for Enterprise Users and Manual Disabling
Not all users are powerless in this data collection effort. GitHub has clarified that paid organizations subscribing to Copilot Business or Enterprise editions, along with verified students and teachers, are protected by contractual terms, and their data will not be used for training.
