OpenAI Teams Up with Former Apple Executive to Challenge Former Employer, Applies for Permanent Termination of Trade Secret Case
On August 27, OpenAI, alongside former Apple executives Tang Tan and Chang Liu, and Jony Ive’s io Products, filed a new court petition seeking to dismiss Apple’s trade secret theft lawsuit with prejudice. This strategic move aims to permanently bar Apple from re-litigating the same claims, signaling a significant escalation in the ongoing legal conflict between established tech giants and emerging generative AI firms regarding talent mobility and core intellectual property.
The dispute stems from Apple’s recent legal action, which accuses former employees Chang Liu and Tang Tan of misappropriating confidential information while joining OpenAI and io Products. Apple alleges that the defendants facilitated the transfer of trade secrets and encouraged job applicants to circumvent Apple’s security protocols. In response, Apple has sought a preliminary injunction to halt the use of proprietary data and requested expedited discovery proceedings to evaluate potential financial damages.

Following Apple’s rejection of a prior dismissal motion on the grounds that the allegations were sufficiently specific, OpenAI countered in its latest filing by arguing that the complaint lacks fundamental factual basis. OpenAI stressed that under the Defend Trade Secrets Act (DTSA), plaintiffs must identify specific trade secrets, demonstrate their legal protection, and provide concrete evidence of misappropriation. Instead, OpenAI argues, Apple offered vague conceptual descriptions masked by subjective speculation. With the exchange of pleadings now complete, the court is scheduled to hold a hearing on October 1st.
