EU unveils AI content labelling playbook ahead of August AI Act deadline

The European Union has released its AI content labeling playbook, a voluntary Code of Practice designed to help companies comply with transparency rules that take effect across the bloc starting August 2. The European Commission published the final Code on June 10, outlining practical steps for businesses that build and deploy generative AI to mark and label outputs from their systems.

The Code itself is voluntary. However, the obligations it refers to are mandatory. These obligations fall under Article 50 of the EU AI Act, and from August 2, 2026, they apply regardless of whether a company signs the Commission's guidance. Signing simply provides a recognized framework for demonstrating compliance.

What the AI Content Labelling Rules Actually Require

Starting in August, two categories must be clearly flagged. Deepfakes and AI-generated or AI-manipulated text published on matters of public interest must carry a label. Additionally, anyone interacting with an interactive AI system, such as a customer service bot, must be informed that they are communicating with a machine.

The Commission presents this as a way to help users identify AI-created or AI-altered content and reduce opportunities for deception. “Europeans have the right to know whether what they see, hear, or read has been produced or altered by AI, especially when such content could influence public debate,” said Henna Virkkunen, the Commission's Executive Vice-President for Tech Sovereignty, Security, and Democracy.

She described the Code as a practical approach to labeling that AI providers and deployers can adopt before the regulations take effect in August. The Code divides responsibilities between the two sides of the AI supply chain. Companies that develop generative models are required to mark their outputs in a machine-readable format, allowing detection downstream.

The companies that deploy these models — those integrating AI into actual products — handle the visible labeling. For AI-generated text on public-interest matters, this applies when the content is published without human review or editorial control. To ensure practicality, the Code relies on open technical standards and a common EU icon, intended to provide users with a consistent visual indicator and relieve businesses from designing their own.

None of this is final. The Code is now open for signatures, and the Commission is encouraging all providers and deployers to sign. It still requires the Commission and the AI Board to assess its adequacy. Separate Commission guidelines are expected to clarify the law and address matters the Code does not cover. Drafted by six independent experts with input from over 180 stakeholders, it is the first instrument to address AI content labeling under the Act.

The timeline is tight. Companies serving European users have less than two months to determine what they need to label and how, and to decide whether to sign. Many of the more complex details still depend on guidelines the Commission has yet to release.
